Legal basis for our data processing

The processing of personal data can be based on various legal grounds. If we need your data to fulfil a contract with you or to respond to enquiries from you regarding a contract, the legal basis for this data processing is Art. 6 para. 1 p. 1 lit. b DSGVO. If we obtain your consent for certain data processing, the legal basis is Art. 6 para. 1. p. 1 lit. a DSGVO. We carry out some data processing on the basis of our legitimate interest, whereby a balancing of your interests worthy of protection and our legitimate interests is always carried out. The legal basis for this is Art. 6 para. lit. f DSGVO. If processing is necessary to fulfil a legal obligation to which we are subject, the legal basis is Art. 6 para. 1 lit. c DSGVO.

 

Below we explain how we process personal data via our website.

 

Data processing during website access

During the mere informational use of the website, i.e. if you do not register or otherwise transmit information to us (e.g. via a contact form), we collect the following technical information (log file data):

- operating system of the end device with which you visit our website.
- browser (type, version & language settings)
- the amount of data retrieved
- the current IP address of the end device with which you visit our website
- date and time of access
- the URL of the previously visited website (referrer)
- the Internet service provider of the accessing system

The collection of this data is technically necessary in order to display our website to you and to ensure stability and security. We (and our service provider) do not regularly know who is behind an IP address. We do not combine the data listed above with other data.
We pass on the collected data to the responsible internal departments or to external service providers, contractors (e.g. hosting) for processing, website presentation, content creation or technical support.
The legal basis is Art. 6 para. 1 p. 1 lit. f DSGVO. Since the collection of data for the provision of the website and the storage in log files are absolutely necessary for the operation of the website and for protection against misuse, our legitimate interest in data processing prevails at this point. Log files are automatically deleted by us after 6 weeks.

We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security procedures are regularly reviewed and adapted to technological progress.

 

Data transmission 

As a matter of principle, your personal data will not be transferred to third parties unless we are legally obliged to do so, or the transfer of data is necessary for the execution of the contractual relationship, or you have previously expressly consented to the transfer of your data.

 
External service providers and partner companies, such as online payment providers or a shipping company commissioned with delivery, only receive your data insofar as this is necessary for the processing of your order / your order. In these cases, however, the scope of the transmitted data is limited to the necessary minimum. Contact

When you contact us by e-mail or via a contact form, the data you provide will be stored by us in order to answer your questions and process your requests. The legal basis in this respect is Art. 6 para. 1 p. 1 lit. f DSGVO. Insofar as we request information via our contact form that is not necessary for contacting you, we have always marked this as optional. We use this information to specify your request and to improve the processing of your request. Any communication of this additional information is expressly on a voluntary basis and with your consent, Art. 6 para. 1 p. 1 lit. a DSGVO.

Furthermore, you can contact us via live chat on our websites www.borbet.de and www.borbet-sports.de. When using the live chat, your IP address, the date and time of the contact and the information you provide in the course of the chat communication are recorded. Further personal information about you is generally not required. You have the option of sending us your enquiries using a pseudonym. The legal basis for the data processing is our legitimate interest according to Art. 6 Para. 1 S. 1 lit. f DSGVO in fast and uncomplicated customer communication.

Should you also voluntarily provide us with personal data, this will also be based on your consent in accordance with Art.6 Para. 1 S. 1 lit. a DSGVO.


Your data that we have received in the course of contacting you will be deleted as soon as it is no longer required to achieve the purpose for which it was collected, your request has been fully processed and no further communication with you is necessary or desired by you. 



Application
You can apply online via our application portal. Your online application will be forwarded directly to the HR department via an encrypted connection and will of course be treated confidentially. Should you nevertheless apply to us by e-mail, we expressly point out that sending unencrypted e-mails or e-mail attachments is not secure.

In order to process your application, we process the personal data you have provided us with, which is usually your applicant master data, qualification data (cover letter, CV, professional qualification), references and certificates and, if applicable, special information that is required due to the position to be filled (e.g. police clearance certificate, Schufa information). Your details will only be used to process your application.

Online orders shop

When you place an online order on our website, we collect the data required for the conclusion of the contract. The data is stored for the duration of the contract and in accordance with legal obligations. As far as necessary for the processing of the order, we forward your address data to a shipping service provider. The legal basis is the conclusion and execution of a contract in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO.

 
For payment processing, we use payment service providers, which are always identified and accept your entries. They are therefore recipients of your personal data collected in connection with the payment process. The legal basis for the involvement of payment service providers is also the processing of the contract in accordance with Art. 6 Para. 1 S. 1 lit. b DSGVO.

Wheel configurator 
We use the tyre and wheel configurator ProVis 4 on our website. The provider is BMF Media Information Technology GmbH, Bürgermeister-Fischer-Str. 9-11, 86150 Augsburg. With the help of the configurator, we offer you the possibility to virtually configure our products to your vehicle model and to make a simplified request for quotation from our specialist dealers.
To do this, you can select a vehicle using predefined selection options for vehicle manufacturers, models and types. Alternatively, you can also select your vehicle by entering your key number (manufacturer key number (HSN), type key number (TSN) and volume key number (VSN). You can then assign the matching wheels offered via the configurator to your vehicle and request an offer directly from our affiliated dealers via our contact form. For this purpose, your first name, last name and contact details (telephone number and e-mail address) and optionally HSN, TSN/VSN number will be passed on to the dealer you have selected.

We have concluded an order processing contract with BMF in accordance with Art. 28 DSGVO in order to ensure the necessary protection of your data and to ensure that your data is processed exclusively on our behalf and in accordance with our instructions.

The legal basis for the data processing is Art. 6 (1) lit. b DSGVO, insofar as the processing is necessary for the implementation of pre-contractual measures in response to your enquiry and your enquiry relates to the conclusion of a contract. Otherwise, the data processing is carried out on the basis of Art. 6 para. 1 lit. f DSGVO in the exercise of our legitimate interest in offering and processing the simplified offer request via the configurator. The legal basis for the processing is our legitimate interest according to Art. 6 para. 1 p. 1 lit. f DSGVO. The purpose of the data processing is the user-friendly and legally compliant design of our website. We want to make it as easy as possible for you to give or withdraw consent and increase the transparency of data processing using cookies, pixels, tags or similar technologies on our website. Our legitimate interest also lies in the purpose of the data processing.
 
We store your personal data as long as it is necessary for the aforementioned purposes as well as for the fulfilment of our legal obligations. Google Maps 

This site uses the mapping service Google Maps. Google Maps is a mapping service provided by Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. The responsible body for users in the EU/EEA and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

In order to use the Google Maps functions, information, including the IP address and the address entered as part of the route function, may be transmitted to the provider's servers. This information is usually transferred to a Google server in the USA and stored there.

When you visit a website that contains Google Maps, your browser establishes a direct connection with Google's servers, whereby the map content is sent to your browser and integrated by it. By using our consent management tool, this is prevented if you have not consented to the data processing with regard to Google Maps. Due to the integration of Google Maps, no data is therefore transmitted without your consent.

The provider of this site has no influence on this data transmission. According to current knowledge, this includes the following data:

We use reCaptcha v2 on our websites. reCaptcha is a service provided by Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. ReCaptcha serves to prevent abusive automated entries in web forms and thus to protect the technical systems of the hoster.

If you call up one of our websites in which reCaptcha is integrated, a connection to Google's servers is established. A reCaptcha cookie is set. Your IP address is transmitted to Google. By using our consent management tool, this is prevented if you have not consented to the data processing with regard to reCaptcha. Google Analytics 4
With your consent, we use Google Analytics 4, a web analytics service provided by Google LLC, on our websites. The controller for users in the EU is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

Google Analytics 4 uses cookies that enable us to analyse your use of our website. The information collected by the cookies about your use of this website is usually transferred to a Google server in the USA and stored there.

Google Ads 
We use the Google Ads service. Google Ads is an online advertising programme from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

This means that we place Google Ads adverts and also use Google Remarketing and conversion tracking as part of this. The adverts are displayed after search queries on websites in the Google advertising network. We also use Ads remarketing lists for search ads. This enables us to customise search ad campaigns for users who have already visited our website. The services allow us to combine our adverts with certain search terms or to place adverts for previous visitors, e.g. advertising services that visitors have viewed on our website. DSGVO, in order to make our company better known through them. The underlying promotional purpose is to be regarded as a legitimate interest within the meaning of the DSGVO. The responsibility for data protection-compliant operation is to be ensured by their respective providers. The social bookmarks are only integrated on our website as a link to the corresponding services. After clicking on the embedded graphic, you will be redirected to the page of the respective provider, i.e. only then will user information be transmitted to the respective provider. We have no influence on the type and scope of data processing that Facebook, Instrgram or their email provider collect with the help of the share function. However, we would like to inform you about this as far as possible. By activating the share function, selected providers receive the information that you have accessed the corresponding page with the content to be shared. If you are a user of a social network such as Facebook or Instagram and are logged into your account at the time of the sharing process, the visit can be assigned to your user account there.
